These Terms & Conditions apply to the use of this website and all photography, videography and media services provided by us.

For the purposes of these Terms & Conditions:

“We”, “us”, and “our” refer to Studio Rob, the service provider.

“Client” refers to any individual, company, agent, or representative who accesses this website or engages our services.

“Services” refers to all photography, videography, aerial, editing, and media-related services provided by us.

By accessing this website or booking services with us, the Client agrees to these Terms & Conditions.

1. Website Use & Content

All content on this website, including images, video, text, branding, and design elements, is owned by us unless otherwise stated. Website content may not be copied, reproduced, distributed, or reused without written permission.

Information provided on this website is for general information purposes only. We reserve the right to update or modify website content at any time.

This website may contain links to third-party websites. We are not responsible for external website content.

2. Booking & Acceptance

A minimum order total of $220.00 AUD applies to all shoots. If the selected services total less than this amount, the booking will be adjusted to meet the minimum and reflected in the final invoice. Different terms may apply for agents or long-standing clients.

A booking is confirmed once written confirmation is received via email, through our Studio Rob Portal booking system, or once payment or deposit has been received. By confirming a booking, the Client agrees to these Terms & Conditions.

We reserve the right to refuse service at our discretion.

3. Pricing & Payment Terms

All prices are listed in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise.

A 50% deposit will be required at the time of booking to secure an appointment.

The remaining balance is payable following the shoot and must be paid within 14 days of the invoice date, unless otherwise agreed in writing. We reserve the right to withhold delivery and usage rights of media until payment has been received in full.

Any media released prior to payment remains our property and may not be used, published, or distributed until the relevant invoice has been paid in full.

We may, at our sole discretion, offer alternative payment arrangements, waive deposit requirements, or release media prior to full payment for approved agents, repeat clients, or long-term working relationships. 

360 Virtual Tour Hosting: The quoted price includes hosting of the 360 virtual tour for a period of three (3) months from the date of delivery. Upon expiry of this initial period, hosting will cease unless the Client elects to continue the service. Ongoing hosting is available at a rate of $9.00 AUD per month, per tour, payable by the Client. Hosting may be extended for as long as required, subject to continued payment.

4. Cancellation & Rescheduling

Rescheduling requests made more than 24 hours prior to the scheduled shoot are generally accommodated at no additional cost, subject to availability.

Rescheduling requests made within 24 hours of the scheduled shoot may incur a rescheduling fee equal to the deposit.

Cancellations made more than 24 hours prior to the scheduled shoot will result in the deposit being forfeited.

Cancellations made within 24 hours of the scheduled shoot time will incur the full fee.

Clients are responsible for ensuring property access is available at the scheduled shoot time. If the property is inaccessible at the scheduled time, or is not ready to be photographed, the full fee will apply.

Exterior photography, videography, and aerial capture are subject to suitable weather conditions.

We reserve the right to reschedule bookings due to weather, safety concerns, or operational requirements.

We may also reschedule or cancel services due to unsafe conditions, illness, equipment failure, airspace restrictions, or circumstances beyond reasonable control.

We may, at our sole discretion, waive rescheduling or cancellation fees for repeat clients or long-term working relationships.

5. Property Readiness

The Client is responsible for ensuring the property is clean, tidy, decluttered, fully accessible, and presentation-ready at the scheduled shoot time.

Cleaning, decluttering, and staging services are not included.

We photograph and film properties as they are presented at the time of the shoot.

We are not responsible for the cleanliness, styling, maintenance, or overall presentation of the property, and no guarantee is made regarding how the property will appear in the final media.

We may adjust small items where necessary to improve composition; however, large furniture or significant rearrangement of the property will not be undertaken.

We may, at our sole discretion, waive the fees outlined in this section for agents, repeat clients, or long-term working relationships.

6. Turnaround Times

Delivery timeframes commence from the completion of the shoot.

Typical delivery timeframes:

• Ground-Based Photography – within 24 hours
• Aerial Photography – within 24 hours
• Floor Plans & Site Plans – within 48 hours
• Photo Editing Services – within 48 hours
• Property Videos – within 72 hours

In rare circumstances outside our control (including weather, technical issues, or power outages), delivery timeframes may be affected.

7. Aerial Services

Aerial services are subject to CASA regulations, weather conditions, and airspace restrictions.

All aerial operations are conducted in accordance with the regulations of the Civil Aviation Safety Authority (CASA).

Flights may be restricted due to:

• Controlled airspace
• Proximity to airports
• Weather conditions
• Safety considerations
• CASA regulations

We do not guarantee aerial availability for every booking.

If aerial services cannot be provided, a partial refund or service adjustment may be offered.

Where aerial services cannot be performed due to these restrictions, alternative services may be offered or a partial refund for the affected service may be provided.

8. Creative Discretion

We retain creative control over composition, editing style, music selection, and final deliverables. Where applicable, the Client may request a preferred music style, which will be accommodated where reasonably possible.

We retain discretion over shot selection and final delivered images.

RAW files, unedited images, and unprocessed video footage remain our exclusive property and will not be provided to clients. Only the final edited deliverables are supplied as part of the service.

Minor revisions may be requested where reasonable. Major revisions or additional editing requests may incur additional charges.

9. Usage Rights & Licensing

The Client is granted a non-exclusive, non-transferable licence to use delivered media for marketing purposes.

Media supplied by us is licensed solely for the marketing of the specific property listing for which it was commissioned. Reuse for future listings, developments, or third-party marketing may require additional licensing or written permission.

Media may not be sold, sublicensed, or distributed to third parties without written consent.

We retain full copyright ownership of all imagery and video content.

We may use selected media for portfolio, website, and marketing purposes.

If requested by the Client, we will refrain from using media from specific properties for promotional purposes.

10. Archiving

Final deliverables are archived for up to 14 days following delivery. After this period, files may be permanently deleted.

11. Travel Fees

Travel within 25 km of 22 Robert Street, Kunda Park, Sunshine Coast is included. Properties located further away will incur a travel fee of $1 per km for the additional return distance beyond 25 km. This fee is automatically calculated during the booking process based on the property address entered and will be updated at checkout if applicable.

This travel fee may be waived at our discretion for long-term or regular agents.

12. Client Responsibility

The Client warrants they have authority to grant access to the property and approve photography or filming.

The Client is responsible for obtaining permission from owners, tenants or occupants where required.

13. Limitation of Liability

To the fullest extent permitted by Australian law, we shall not be liable for loss of business or profits, marketing outcomes, property sale or rental results, delays caused by weather or third-party platforms, indirect or consequential losses.

Our total liability is limited to the value of the services provided.

14. Force Majeure

We are not liable for failure or delay caused by circumstances beyond reasonable control, including severe weather, illness, equipment failure, government restrictions, natural disasters.

15. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

16. Amendments

We reserve the right to update these Terms & Conditions at any time.

17. Safety & Access

We reserve the right to refuse or discontinue services if a property is deemed unsafe or unsuitable for photography, videography, or aerial operations.

This includes but is not limited to:

• Unsafe structures
• Hazardous environments
• Aggressive animals
• Restricted airspace
• Conditions that pose a risk to people or equipment

If services cannot proceed due to safety concerns upon arrival, the booking may be rescheduled and a rescheduling fee equal to the deposit may apply.

18. Late Payments

Invoices not paid within the stated payment terms may incur reasonable administration or recovery costs where applicable.

We reserve the right to suspend future bookings or services until overdue balances are paid in full.
